Are Undocumented Workers Covered Under Workers’ Compensation?

A Business Insurance Update

With all the talk these days about illegal immigration, we thought it might be good to answer a common question. That is, are undocumented workers covered under workers’ compensation?  According to the U.S. Department of Labor and Homeland Security, undocumented immigrants make up 3.2 percent of the United States’ population.  The Federal Government requires that all employers verify their employee eligibility to work in the U.S.

In many states, undocumented workers can get workers’ compensation because the state’s statutes specifically include undocumented employees.  Some States such as AZ and WY, have ruled undocumented workers are not eligible, as they can’t legally enter into a contract of employment. Workers’ compensation insurance protects employers from claims resulting from injuries to employees. It protects your business from lawsuits and provides employees with compensation for on-the-job injuries.
